Speaker: Bankruptcy attorneys Felicita Torres and Lauren Rode of Griffith & Thornburgh, LLP

Felicita (“Cita”) spent seven years working at the U.S. Bankruptcy Court, Central District of California, as a law clerk to the Honorable Robin L. Riblet (Ret.), prior to joining Griffith & Thornburgh, LLP in 2014. Cita handles insolvency and bankruptcy matters, from prebankruptcy consultation for individuals and businesses, to representing creditors and trustees in bankruptcy litigation and contested matters. Cita received her law degree from Harvard Law School and her undergraduate degree from Stanford University. She has been a partner at Griffith & Thornburgh, LLP since 2018.

Before moving to Santa Barbara in 2017, Lauren worked for a firm in Los Angeles, where she handled all of the firm’s Chapter 7 and 13 bankruptcy matters throughout all four districts in California. Prior to law school, Lauren worked at Pachulski, Stang, Ziehl & Jones, one of the most prominent insolvency practices in the nation. Lauren received her law degree from University of Minnesota Law School and her undergraduate degree from Cornell University. Lauren joined Griffith & Thornburgh, LLP in 2020. In addition to representing clients in bankruptcy matters, Lauren has an active family law practice. She and Cita collaborate to address client issues arising at the intersection of family law and bankruptcy.

SBCBA Estate Planning/Probate Section Presents: “Drafting Considerations for the Asset Protection Trust”

About the Event: Often an attorney will utilize the trust form supplied by an offshore trustee company to expedite the process of implementing an asset protection trust for the client. We have found serious problems with such supplied trust forms. Quite frequently such forms do not take into consideration U.S. tax consequences and other important matters.

This presentation covers the use of special provisions for asset protection trusts (applicable to both domestic and offshore trusts). The discussion includes (examples): trust protector provisions (an oversight facility) – what they are, sample language, how they are used, what they should include; flight provisions (moving the trust from one jurisdiction to another) – what they are, sample language, how they are used, when it is appropriate to use, what they should include, mechanism to ensure its functionality; duress provision – what it is, sample language, how it is used, what it should include, mechanism to ensure voluntary acts only; effect of discretionary distribution/allocation provisions, and others.

About the Event: The rise of e-commerce and crypto currencies has led to a cottage industry of scammers setting up fraudulent websites. Commonly, a scammer will pose as a legitimate internet retailer, take orders and collect payment from unsuspecting customers, and deliver nothing or counterfeit product in return. These websites frequently infringe the trademarks, trade dress, and copyrights of bona fide merchants and service providers or misuse the personal data of customers or users lured to the deceptive site. Scammers know it will take several months to remove a fake website from the internet via traditional federal litigation and injunctive relief. By the time a court orders a website removed or de-indexed, the swindlers have made off with thousands of dollars from fraudulent sales or valuable personal information and moved on to create another fake website.

While litigation is expensive, time consuming, and less than effective in addressing ongoing online scams and infringement, takedown notifications offer a much faster and more cost-effective means of eliminating counterfeit websites. Join us to learn about various federal, state, and foreign statutes and specific procedures that can be used to get a fraudulent website offline.

Speaker: Brian S. Tamsut

Brian Tamsut is an attorney with SoCal IP Law Group in the firm’s Westlake Village office. His practice focuses on patent and trademark prosecution, intellectual property litigation in federal courts, and alternative strategies for addressing online fraud, scams, and infringement. Brian attended UC Irvine School of Law as an Erwin Chemerinsky Merit Scholar. During law school he worked pro bono for the UC Irvine Intellectual Property, Arts, and Technology Law Clinic, where he represented copyright holders before a federal rulemaking agency and testified about the Digital Millennium Copyright Act (DMCA) before the United States Copyright Office.

SBCBA Employment Law Section Presents: “Understanding the Nuts and Bolts of Employment Practices Liability Insurance (EPLI)”

About the Event: Employment-related claims have exploded in recent years and can pose an existential risk, particularly for small employers. Statistics suggest employment-related lawsuits represent at least one fifth of all suits filed in the US, and three out of four companies will face an allegation of employment practices liability.

One-way employers can manage the risk and cost posed by this growing trend is to purchase Employment Practices Liability Insurance (EPLI). However, while EPLI unquestionably offers protections, it is crucial for employers (and their counsel) to possess a minimum understanding of this product, including limitations of coverage, deductibles, choice of counsel and other important provisions. This approved 1-hour MCLE presentation will provide an understanding of the nuts and bolts of EPLI.
