About the Event: Last session, the Legislature passed a number of new laws aimed at reducing sentences. Now that the courts have had a couple of months to interpret some of them, we will be discussing what has changed, and who may be affected.

“Non-Fungible Tokens: A Primer and Legal Guide to NFTs”

Description: Non-Fungible Tokens (NFTs), the latest rage in blockchain technology, have burst into the entertainment and media space, creating new markets and opportunities for artists, musicians, sports stars, brands, technology platforms, investors, and consumers. NFTs raise a profusion of novel legal questions involving intellectual property, advertising, consumer protection, and regulatory matters.

This program will explore some of the basic questions and fascinating legal issues raised by NFTs. What are NFTs and why do they have value? How are they being used in the marketplace, and who are the major players? How do NFTs fit into the cryptocurrency and blockchain landscape? What IP or other rights are needed to “mint” an NFT? What are the rights of an NFT owner? How do you enforce contractual terms associated with an NFT? Will NFTs generate litigation? “How to Find and Use Location Information in Litigation”

Description: Determining the location of an individual at a specific point in time can make or break a case. You can use location data to present an alibi in defense, discredit a witness or party, show how long someone was on the road prior to a crash, establish where a digital contract was signed, and more. This unique webinar will show you how to find and use location data in your case. We will answer your live questions, and walk through real-world location analysis. You will come away knowing where to find data to support your case, as well as how to analyze some of the data yourself.

Speaker: Brian Chase is a Director of Digital Forensics at ArcherHall, an expert witness, and an adjunct professor of law. Before joining ArcherHall, he was a practicing attorney and the owner of Chase Technology Consulting, a legal technology consulting firm providing digital forensics and e-discovery expertise.  He has worked with various sized law firms both in an IT and legal capacity. He has consulted with firms on their use of technology within the office, and has provided expert testimony in criminal and civil matters ranging from misdemeanors to murder to medical malpractice.

“What Kanye West Can Teach Us About Litigation”

“Off the Clock: Professional Ethics on Personal Time”

Speaker(s): Wendy L. Patrick is a past Chair and advisor to the California State Bar’s Ethics Committee. She is a Deputy District Attorney with over 165 trials, ranging from first-degree murder to domestic violence to stalking. She has been selected as one of the Top Ten criminal attorneys in San Diego and named the Ronald M. George Public Lawyer of the year. Wendy is an author and media personality who has appeared multiple times on CNN, Fox News Channel, Fox Business Network, and a variety of other national news programs.

About the Event: Most legal ethics programs focus on how applicable rules, laws, and related opinions govern a lawyer´s behavior when he or she is practicing law. But what rules apply to a lawyer´s behavior off the clock?

The answer is: ethically, a lawyer is never off the clock. This program will focus on the rules, statutes, case law, principles, and guidelines that govern a lawyer’s actions, conduct, and speech, during personal time. It will break down and analyze Professional Rule of Conduct 8.4, Misconduct, breaking down each subsection into informative, practical examples, and present practical illustrations and informative case examples from around the country of how off-the-clock behavior can have on the job consequences.

This engaging program will address, among other things:

Abbe Kingston is the senior attorney in charge of overseeing all immigration matters for Kingston, Martinez & Hogan. He is a founding partner of the firm and has practiced immigration law in Santa Barbara for over 35 years. He has been certified by the California State Bar as an Immigration and Nationality Law Specialist since 1988. He was appointed as a Commissioner on the California State Bar Commission on Legal Specialization for a period of three years. Abbe earned his Bachelor of Science degree from the University of California, Santa Barbara, and his law degree from Loyola Law School. Abbe has published several law review articles, as well as appeared on local and national news as an immigration expert.

Tanya A. Ahlman

Tanya Ahlman is a Partner at Kingston, Martinez & Hogan LLP. She has been certified by the California State Bar as an Immigration and Nationality Law Specialist. Tanya specializes in employment-based immigrant and non-immigrant visas, including the transfer of personnel from multi-national companies. She received her law degree from Georgetown University Law Center and previously practiced law for the Office of the District Attorney of Santa Barbara County. She is admitted to practice law in California, New Jersey, New York, and the U.S. Virgin Islands.

Andrea M. Anaya

Andrea Anaya is a Junior Partner with Kingston, Martinez & Hogan LLP. She practices immigration law, specializing in family-based immigration, Deferred Action for Childhood Arrivals (DACA), Temporary Protected Status (TPS), deportation/removal defense, crimmigration and federal immigration litigation. “Representing Incarcerated TGI People”

Speaker: Alex Binsfeld (they/them) is a white non-binary queer person who is the Legal Director of the Transgender, Gender-Variant, and Intersex Justice Project (TGI Justice Project). They were born & raised in the San Francisco Bay Area and graduated from the University of California, Hastings College of Law with a social justice concentration. They have engaged in transgender rights advocacy for nearly a decade as a student activist, law clerk and volunteer.

About the Event: The TGI Justice Project works in collaboration with others to forge a culture of resistance and resilience to strengthen us for the fight against human rights abuses, imprisonment, police violence, racism, poverty, and societal pressures. The mission of TGIJP is to challenge and end the human rights abuses committed against Black, Black/Brown trans people inside of California prisons, jails, detention centers and beyond. This presentation covers basic skills to branch out into pro-bono support of TGI people and the TGI Representation Network where one can gain expert mentorship and entry-level non-litigation cases.
