SB 940 created a new system for certifying ADR neutrals designed chiefly to encourage commitment to various ethical standards. But it delegated to the State Bar the task of working out much of the detail. What led to this legislation? Does it really solve a problem? What will it entail? What problems could result? How can it be implemented to mitigate the risks? When will it go into effect And what do ADR neutrals need to do to prepare?
